"His Excellency Mr. Abdelaziz Bouteflika, President of the Republic, chaired a meeting of the Council of Ministers, this Wednesday, December 27, 2017.
The Council of Ministers examined and adopted the draft law on the protection of individuals in the processing of personal data, presented by the Minister of Justice. This text accompanies the development of the digital processing of administrative, legal and financial data, in the numerous sectors of the public service. It will regulate the protection of individuals when processing their personal data. As such, the bill states in particular (i) the exclusion of the exclusive private use of data of its processing, (ii) the need for the consent of the concerned individual in the processing of his personal data, except in cases of legal obligations (iii) the institution of an enhanced protection to protect the personal data of the child, (iv) and the institution of a national authority for the protection of personal data, under the authority of the President of the Republic.
The Council of Ministers examined and adopted also a draft law on the revision of the Code of Criminal Procedures, presented by the Minister of Justice. This revision concerns first of all the criminal record, which citizens residing abroad can in the future withdraw at embassies and consulates.
The citizen will also be able to consult his criminal record N°2, which will avoid the situations where litigants are condemned without knowing it. Finally, the revision will establish the criminal record for legal persons, which will consolidate the transparency of transactions. Under the same revision, the regime of arrest and detention will henceforth be implemented only after a final judgment.
Finally, the revision of the Code of Criminal Procedures will allow citizens convicted by foreign jurisdictions with registration in the criminal record, to seek their rehabilitation in the Algerian courts after the legal deadlines. Following the adoption of these two bills, the President of the Republic invited the government to continue the deepening of the justice reform, which has already taken many steps, and which will also take over the provisions of the last year amended Constitution, particularly those relating to the protection of the rights and freedoms of citizens.
The President also insisted that justice, through its laws and human skills, adapt to the consequences of national economic changes as to arbitrate disputes and conflicts in the business world. The Council of Ministers subsequently examined and adopted three presidential decrees relating to the exploration and exploitation of hydrocarbons. Two of these decrees approve contracts by which ALNAFT allocates to SONATRACH the research and exploitation on the perimeter denominated "BOURARHAT" in the wilaya of Ilizi and on the perimeter denominated "AHNET" in the wilaya of Adrar. The third decree approves an amendment to a contract concluded in 2000 between SONATRACH and the companies PETRONAS and CEPSA for the exploitation of the "RHOUDE ERROUMI" perimeter.
The amendment approves the sale by PETRONAS to CEPSA of all of its shares in this area. Following the examination of the items on the Council of Ministers' meeting agenda, the President of the Republic referred to the expression, in recent days, in some wilayas of the country, of claims on the teaching of Tamazight. In this regard, President Abdelaziz Bouteflika recalled that the last year revised Constitution sealed once and for all the appropriation by the entire people of Tamazight, also as a national and official language, additional cement to the national unity, at the same time that the Nation has mandated the State for its promotion and development.
The President urged the government to spare no effort to generalize the teaching and use of Tamazight, in accordance with the letter and spirit of the Constitution. The President of the Republic also instructed the government to accelerate the preparation of the draft organic law establishing an Algerian Academy of the Amazigh language. In the same spirit, and by presenting his best wishes to the Algerian people on the eve of the year 2018, President Abdelaziz Bouteflika announced his decision to devote Yenayer as a holyday as of January 12.
The government has been charged to make appropriate arrangements for this purpose. This measure, like all those already taken for the benefit of our national identity in its triple Islamic, Arab and Amazigh component, will consolidate national unity and stability, while we face multiple internal and regional challenges, concluded President Abdelaziz Bouteflika ".
